1. Introduction
These General Terms and Conditions of Sale and Guarantees (hereinafter referred to as "General Terms and Conditions of Sale and Guarantees") exclusively regulate the contractual relations between the customers of the racingtime.shop website (hereinafter referred to as "Customers") and the seller Racing Time s.r.l with Fiscal Code and VAT number IT03886500986 (hereinafter referred to as "Seller"). These General Conditions are the only ones that can be applied and replace all other conditions, except for prior, express, and written derogations. The Seller may be obliged to modify some of these conditions; therefore, the Customers are advised to read the General Conditions of Sale and Guarantees for each purchase on the racingtime.shop website (hereinafter referred to as the "Website"). Each purchase on the Website is subject to the General Terms and Conditions of Sale and Guarantees applicable on the date of the order. The Seller trusts that, once the order has been validated, the Customers have read and accepted without reservation the General Terms and Conditions of Sale and Guarantees. The Customers undertake to comply with the General Terms and Conditions of Sale and Conditions of Use detailed in the 22 points in this section.

2. General Introduction
Our Racingtime.shop website sells accessories for bikes with high technological and innovative content. The sale takes place exclusively through our online Site at the address http://racingtime.shop owned by the Vendor which sells goods or services through the online sale, i.e. the contract entered into exclusively within the system of distance communication commonly known as the Internet.

3. Product Orders

Our products can be ordered from our website http://racingtime.shop 24 hours a day, 7 days a week. The ordering process at the checkout consists of the following steps. Once the choice of products has been made and the shopping cart has been validated, Customers will be at checkout:

- choose whether to create an account or proceed as a guest - alternatively, if they are already registered users, log in

- enter their (buyer's) data and choose whether to send to an address other than the sender's address

- if the Customer chooses a different shipping address in step 2, they shall enter the details of the shipping address

- choose the shipping method from the various options offered

- choose the payment method from the various options offered

- check the order, the correctness of the data entered, and confirm the purchase 

In order to confirm the purchase, the customer will have had to accept the General Terms and Conditions of Sale which will definitively formalize the sales contract binding them to the Seller.

The order process at the checkout consists of the following steps. Once the choice of products has been made and the cart validated, customers will find themselves at checkout:
- choose whether to create an account or proceed as a guest - alternatively, if you are already a registered user, log in
- enter your data (of the buyer) and choose whether to ship to another address other than the sender address
- if in point 2 a different shipping address is chosen, enter the shipping address data
- choose the shipping method from the various options proposed
- choose the method of payment among the various options proposed
- check the order, the correctness of the data entered and confirm the purchase 

To confirm the purchase, the customer must have accepted the General Conditions of Sale which will definitively formalize the sales contract that binds them to the Seller.

4. Information on Products
All information related to the characteristics, description, illustrative photographs of the products on our site is provided by our suppliers or created by our staff. Should it become necessary, the Seller reserves the right to modify or adapt the information of the products in the catalog even without prior notice. 

5. Sales
All the sale prices of the products indicated in the catalog on the Website are expressed in euros as the final price but do not include shipping costs or cash on delivery fees, which are always charged to the Customers. The Seller reserves the right to change the prices at any time without prior notice but undertakes to apply the prices indicated on the Site at the time the order is placed.

6. Minimum order
There is no minimum order amount; you can also order a single product.

7. Product Availability
The availability of products is always indicated and updated to 95% in our online catalogs on our site. The status is divided into two categories:
- available
- not available

If the purchased item is no longer available, the Seller will contact the customer by e-mail or by telephone within 24 hours of his purchase, informing him of the unavailability of the item, offering three possible solutions in the following order of priority:
- replacement with another item of equal value, in the case of a lower cost, the Seller will refund the difference, in the case of a higher cost, the Customer will have to integrate the payment of the missing difference
- if the customer has purchased more than one item, refund partial amount of the missing item
- if the customer only bought one item, full refund of the order

8. Accepted Payment Methods

The Seller uses the PayPal payment method to guarantee the security of Customer payments and the confidentiality of the credit card data used. Other payment methods are possible by bank transfer. For the bank transfer payment method, the customer has 5 working days to make the payment. If payment is not made within 5 working days, the Seller shall cancel the order without notice.

9. Shipping costs in Italy

The shipping costs are fixed throughout the Italian territory regardless of the weight of the package and the number of products purchased:
18.00 EURO (shipment with express courier 150.00 EURO)
0,00 EURO (shipment with the express courier for orders over 150,00 EURO)

In case of shipment to Calabria, Puglia, Sardinia, and Sicily, the delivery time is estimated to be at least 24/48 hours longer than in the rest of the regions.

11. Delivery methods in Italy
The shipments proposed by the Seller are made in Italy with DHL or BRT courier. The products purchased on our website are delivered only in Italy, with the exception of San Marino and Livigno. The Seller reserves the right to change the couriers used or the delivery methods at any time without prior notice but undertakes to apply the couriers and delivery methods indicated on the Site at the time the order is placed.

12. Delivery methods in Europe
The shipments proposed by the Seller are made in Europe by parcel with DHL or DPD courier. The Seller reserves the right to change the couriers used or the delivery methods at any time without prior notice, but undertakes to apply the couriers and delivery methods indicated on the Site at the time the order is placed.

The Seller reserves the right to calculate the actual shipping costs and, for bulky and low-value materials, may request an extra charge, whereby the customer may accept the proposal or obtain a full refund of his order within 48 hours. Shipments proposed by the Seller are made by DHL or DPD courier. Shipments are governed by the laws of interchange of goods, so the charges and taxes to be paid by the Customer will be applied to customs. The Seller reserves the right to change the couriers used or the delivery methods at any time and without prior notice, but undertakes equally to apply the couriers and delivery methods indicated on the Site at the time the order is placed.

13. Images, Texts, Graphics 
All images and some texts of the products on our site are covered by copyright and are the property of manufacturers or suppliers or the company Racing Time Srl. Their use is granted to the Seller as an authorized seller or because of the purchase of products from a wholesaler or factory that provides only original articles with the Conai contribution paid. Any abuse and / or non-compliant use will be prosecuted in accordance with the law.

14. Warranty
Racing Time Srl is not responsible for damages or accidents deriving from the products sold which could occur if the customer uses the products improperly and without following the instructions provided. Due to the heavy nature of off-road use, products are not covered by warranty after they have been assembled. The warranty is only valid for material defects in products that have not yet been assembled. Each customer is responsible for the correct use of the product purchased from Racing Time Srl. The limit of our responsibility cannot, in any case, be higher than the selling price of the product.

15. Complaints
Any customer complaints can be sent by e-mail to info@racingtime.shop.

16.1 Right of Withdrawal - D.LGS N.206 / 2005
The Customer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the Customer or a third party, other than the carrier and the Customer, acquires physical possession of the goods. In order to exercise the right of withdrawal, the Customer must inform us at the following address: (RACING TIME Srl - Via Pregalleno N° 24 - 24016, San Pellegrino Terme (BG) - Italy | Codice Fiscale e P.IVA IT04352330163) of his decision to withdraw from this contract by means of an explicit statement (e.g. letter sent by post or e-mail). To this end, the Customer may proceed with the return via the form available in the dedicated section of his account or use any other explicit declaration. We will send you confirmation of receipt of the withdrawal by e-mail. In order to comply with the withdrawal period, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

16.2 Effects of withdrawal
If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery to offered us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, he will not have to incur any costs as a consequence of this reimbursement. The reimbursement can be suspended until the goods are received or until the demonstration by the consumer that he has returned the goods, if earlier. Please send the goods back to RACING TIME Srl - Via Pregalleno N ° 24 - 24016, San Pellegrino Terme (BG) - Italy | Tax Code and VAT number IT04352330163  without undue delay and in any case within 14 days from the day on which you communicated your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired. The direct costs of returning the goods will be at your expense, you can follow two methods: 

- request collection by one of our couriers at a cost of 18.00 euros (for Italy);
- proceed with the shipment independently using your courier.
The Customer shall only be liable, if any, for any decrease in the value of the goods resulting from any handling of the goods other than that necessary to establish the nature, characteristics, and functioning of the goods.  

16.3 Exclusion of withdrawal
The right of withdrawal cannot be exercised after the product has been assembled or after signs of wear or abrasion are evident on the surface of the product.

16.4 Size change conditions
If, upon receipt of the goods, the Customer notices that they have purchased the wrong size, the Seller allows them to exchange the product within 14 days from the date of receipt, provided that the product has not been used, assembled, or damaged. The Seller will not accept exchanges or returns of used or damaged products. In the event of unavailability of the size concerned, the Customer will be allowed to exchange one model for another by prior agreement with the Seller. Any return of purchased items must be carefully packaged and include the delivery note or return form duly completed.

If the delivery note is not available at the time of the exchange, the customer has to fill in the return form by accessing the return page (in the section My orders of "My account" if the user is registered or in the section Orders if the user is not registered) available on racingtime.shop. The Customer is kindly requested to return the goods to RACING TIME Srl - Via Pregalleno N° 24 - 24016, San Pellegrino Terme (BG) - Italy | Fiscal Code and VAT number IT04352330163 without undue delay and in any case within 14 days from the day he communicated to us his wish to change the size of the product. The deadline is met if the Customer returns the goods before the 14-day period has expired.

The direct costs of returning the goods shall be borne by the Customer, who may follow two procedures

- request collection by one of our couriers at a cost of €18.00;

- proceed with the shipment independently, using its own courier.

The direct costs of sending the product with the correct size from the Seller to the Customer will be

- charged to the Customer in the case of a single product with a sale price of less than 250 euros (at a cost of 18.00 euros)

- at the expense of the Seller in the case of a single product with a sale price of more than 250 euro. 

17. Responsibility

The Seller shall not be held liable for inefficiencies attributable to force majeure that prevent, in whole or in part, the execution of the contract within the agreed time. The Seller shall not be liable for any damages, losses and/or costs incurred as a result of the non-execution of the contract due to the aforementioned causes, the Customer being entitled only to a refund of the price paid.

In contracts that require the Seller to ship the goods, the risk of loss or damage to the goods remains with the Seller until the Customer takes physical possession of the goods. If, however, the Customer proposes alternative means of transporting the goods to those proposed by the Seller, then the risk of shipment remains with the Customer, without prejudice to the Customer's right against the carrier.

Unless otherwise agreed by the parties to the sales contract, the Seller is obliged to deliver the goods to the Customer without undue delay and at the latest within thirty days from the date of conclusion of the contract. The obligation to deliver is fulfilled by transferring the material availability or otherwise the control of the goods to the Customer. If the Seller does not fulfil its obligation within this period, the Customer invites the Seller to make the delivery within an additional period appropriate to the circumstances. If the additional period thus granted expires without the goods having been delivered, the Customer is entitled to terminate the contract.

Subscription to the Seller's newsletter is possible through the appropriate newsletter registration box located at the bottom of the Site or at the checkout during the purchase phase by ticking the appropriate box. It is possible to unsubscribe from the Seller's newsletter, using the unsubscribe link at the bottom of any newsletter received.

21. Jurisdiction
For civil disputes relating to the application of this contract, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.

22. Alternative dispute resolution
Consumers resident in Europe are hereby informed that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to contracts for the sale of goods and services stipulated online and / or deriving from them. Consequently, if you are a Consumer established in Europe, you can use this platform for the resolution of any dispute arising from the online contract stipulated on this site. The European ODR platform is available at the following link:   https://webgate.ec.europa.eu/odr
